Fenchel Family Law Founding Attorney Valerie Fenchel was featured in ThinkAdvisor, a publication for financial advisors, in an article on the financial planning couples should do before entering a “gray marriage” — a marriage later in life, often after age 65.
Fenchel, who represents founders, executives, business owners, and other high-net-worth individuals, told the publication she regularly sees gray marriage in second marriages where each spouse brings significant assets. She emphasized that a prenuptial agreement should be prepared early and paired with full financial disclosure on both sides. “Incomplete disclosure is the most common way these agreements get challenged later, and it’s an easy problem to avoid if advisors flag it before the drafting even starts,” she said. She also stressed that estate planning should move in lockstep with the prenup, so that wills, trusts, and beneficiary designations reflect the same intentions — especially when adult children from prior relationships are involved.
