How a trust is treated in a divorce depends on several factors: when it was created, how it was funded, what type of trust it is, how distributions were used during the marriage, and whether trust assets were commingled with marital property. The answers to these questions determine whether trust assets are community property subject to division, separate property protected from division, or something in between.

How Trust Type Shapes the Analysis

Not all trusts are treated the same way in divorce. The starting point in any case is identifying what type of trust is involved and understanding the rights and interests each spouse holds in relation to it.

Revocable Living Trusts

A revocable living trust is the most common estate planning vehicle used by California couples. The grantor retains full control and they can modify, revoke, or dissolve the trust at any time and access its assets freely. Because of this control, California courts treat the assets inside a revocable trust as if they belong directly to the grantor for purposes of property division. The trust structure itself does not change the characterization of the underlying assets.

If a revocable trust was funded with community property, meaning assets acquired during the marriage, those assets remain community property subject to division. If it was funded with separate property, those assets retain their separate property character. Where both types of assets were placed into the same trust, which is common, the trust will likely need to be dissolved and its assets characterized and divided individually.
