The Risk of No Agreement

California's community property presumption is the starting point in every divorce. Without a valid prenuptial or postnuptial agreement in place, the default rules apply, and those rules do not distinguish between a spouse who built wealth over a lifetime and one who benefited from it during a marriage.

Specific risks that arise without a protective agreement include:

  • Inherited assets that were deposited into joint accounts or used to support the marital lifestyle losing their separate property character through commingling
